美国SEC委员Peirce发文警示加密 Vault 与借贷策略或涉证券法监管

PANews 7月22日消息，据美国证监会官网，SEC 委员 Hester Peirce 发布声明称，加密资产“上链”并不当然将相关活动排除在联邦证券法适用范围之外。声明指出，利用智能合约在链上配置资产以获取收益的 crypto vault 和借贷策略，若由特定个人或团队决定质押、出借配置、利率、可接受资产、LTV 比例和清算阈值，可能构成共同企业、投资公司或证券化票据，相关参与方需审视是否触及证券发行、投资顾问等监管要求。Peirce 表示，欢迎从业者与 SEC 沟通合规路径，并就现行规则如何调整以容纳 vault 和链上借贷提出意见。
